Principles of the Law of Aggregate Litigation

This project provides the Institute with an opportunity to make useful progress by supplying up-to-date coherence to an area of the law that is important and has changed significantly in recent years. In addition to formal aggregation in litigated settings, such as with class actions, this project addresses a broader array of cases that are bundled together and settled or tried to test the value of related claims. The Discussion Draft contains three Chapters, the first of which deals with basic principles of aggregation, the second with resolution of common issues in litigation, and the third with settlement of aggregated cases.
