Volumes 1 and 2 embrace general matters of terminology, the creation and general characteristics of freehold estates, and the large body of material stating the characteristics of future interests. Volume 3 completes future interests and includes not only the construction of limitations, but also the law applicable to powers of appointment and expectancies. Volume 4, which treated generally the social restrictions imposed upon the creation of property interests, including the restrictions upon the purposes for which trusts can be created, the rule against perpetuities, and the rules against accumulation, is out of print and has been superseded by Volume 1 of Restatement of the Law Second, Property (Donative Transfers). Volume 5, which deals with servitudes-easements, licenses, promises respecting the use of land, duration, interpretation, discharge, and defenses and extinguishment by public authority-is also out of print and has been superseded by Restatement of the Law Third, Property (Servitudes), but it is accessible on Westlaw and Lexis, and on the Restatement CD-ROM, which is available from the West Group. The Institute has recently completed a reformulation of the law of servitudes (see Restatement of the Law Third, Property (Servitudes). Appendix Volume 6 contains all citations to unsuperseded portions of the original Restatement through June 1992, and textual revisions from the Restatement of the Law 1948 Supplement, which is now out of print. Volume 6 is updated by a cumulative annual pocket part.
