A Model Land Development Code aims to coordinate and integrate all state legislation intended to control or influence the development of land. Issues addressed by the Code include the distribution of authority between the state and local governments and the extent to which a formal plan should be prerequisite to regulation. Other important features of the Code are the provisions authorizing public acquisition and disposition of interests in land for the purpose of facilitating development or conservation or to achieve planning objectives, including the discontinuance of an existing use (in cases where the owner fairly should be compensated); the systematic treatment of enforcement and judicial review; and the effort to enhance the accessibility of information about governmental action in these fields by improved recordation.
