CLE Program and MCG Meeting: ALI Project on Restatement of
the U.S. Law of International Commercial Arbitration

This program will be held on Sunday, May 17, from 2:00 to 4:30 p.m. in the State Room. It is not restricted to ALI members and will be webcast live by ALI-ABA.

Description
The program will cover topics thus far treated by the project’s Reporters in what is still an early stage of the project. These topics include:

  • Challenges in Sorting Out Even the Fundamentals of Recognition and Enforcement of Awards
  • Challenges in Sorting Out the Grounds for Denying Recognition and Enforcement
  • Drawing the Interface between Vacatur and Enforcement of Awards

In 2007 the Institute initiated a new Restatement project to deal with a subject area of huge and increasing importance in American law today, the law of international arbitration. The project was started by Columbia Law Professor George Bermann, an outstanding scholar and experienced practitioner in international arbitration, who gathered a team of excellent scholars to work under him as Associate Reporters.

The four Reporters have thus far produced a preliminary draft containing three chapters as well as a tentative outline of the entire Restatement. A revision of that draft will be distributed for this program. In revising the material, the Reporters will take into account the comments on the first draft, including those received at a small New-York-based invitational conference in February.

The project from its very inception has generated a great deal of interest and has already attracted a number of ALI members to join the project’s Members Consultative Group. This program will offer the first opportunity for that Group, as well as any other interested ALI members and non-members, to learn about the project, to hear the Reporters’ thinking on the topics covered in the program, and to comment on the draft and ask questions of the Reporters.

There is no charge to attend in person; however, for those who want to obtain CLE credit for attendance at this program and/or the project presentations at the Annual Meeting, there is a $100 administrative fee. All attendees will receive the program materials and free future access to the online archived program. On-site registration begins at 1:00 p.m.
