Yale Law Robert R. Slaughter Professor of Law Justin Driver delivered the annual Brainerd Currie Memorial Lecture at the Duke University School of Law in April.
The lecture, “Judging Requires Judgment,” examined the current moment in constitutional law and identified areas of interpretive common ground that are often overlooked. Despite widespread agreement, Driver argued that the dominant vision is anything but universal, as a growing number of influential jurists and scholars have articulated and defended an alternate of judging. The lecture was subsequently published in the Duke Law Journal.
