The ALI-ELI Principles for a Data Economy at UNCITRAL

On April 8, the UNCITRAL Working Group on Electronic Commerce held a session on data transactions where they discussed the main concepts developed by Principles for a Data Economy.  

Launched by ALI Council in 2018, Principles for a Data Economy is the first joint undertaking with the European Law Institute (ELI), which, much like the ALI, is a membership-based, independent nonprofit organization with the mission of providing guidance on legal developments. The project was completed by both organizations in 2021. 

Christiane C. Wendehorst, Reporter on the project for the ELI, presented the main concepts of the Principles to the Working Group, emphasizing the types of data transactions, corresponding default terms, and the protection of third-party rights in data supply chains.  

UNCITRAL noted that the project’s section on data rights will be used as a source of inspiration for future legislation. The segments on data rights regarding co-generated data, data rights for public interest, and leapfrogging were adopted by the Working Group as central points.

Rankin Professor of Law and faculty director of the Solomon Center for Health Law and Policy at Yale Law School, has been selected as a new member of the board of the New York City Bar Association, its leadership body.
