Since the U.S. Supreme Court first cited drafts of the Restatement of the Law of Trusts in 1933, the high court has turned time and again to the work of ALI, relying on the Institute’s publications in cases as diverse and influential as Roe v. Wade and New York Times Co. v. Sullivan. This year has been no exception, as the ALI’s work has already been cited in 14 percent of the Court’s published opinions in the October 2014 Term.
39 sections of the Restatements of the Law or the Model Penal Code were cited in opinions authored by eight of the nine justices.
