Decoding Consumer Contracts: Key Legal Developments for Today's Practice

January 07, 2025

Restatement of the Law, Consumer Contracts Reporters Omri Ben-Shahar of the University of Chicago Law School and Florencia Marotta-Wurgler of NYU School of Law will be joined by Alan S. Kaplinsky of Ballard Spahr and Steven O. Weise of Proskauer Rose to discuss consumer contracts on January 29 at Noon Eastern.

Consumer contracts touch nearly every aspect of daily life. Yet, unlike traditional contract law, the law of consumer contracts presents a fundamental challenge to practitioners, because of the asymmetry in information, sophistication, and stakes between the parties to these contracts: the business and the consumers.

This webcast dives into the practical and theoretical aspects of consumer contract law with the guidance of The American Law Institute’s Restatement of the Law, Consumer Contracts. The session combines a thorough analysis of key sections of the Restatement from the project’s Reporters and Advisers, focusing on high-impact provisions and actionable strategies for attorneys.

Using real-world examples and illustrations, participants will learn to navigate issues such as reasonable notice, contract formation, and compliance with federal and state laws. The program also addresses how attorneys can adapt to evolving standards, highlighting the Consumer Financial Protection Bureau’s (CFPB) role in shaping consumer contract provisions.

Key Takeaways:

  • Learn practical approaches for addressing issues related to reasonable notice and contract terms through illustrations and commentary.
  • Explore the CFPB’s influence on consumer contracts and ensure compliance with federal and state laws.
  • Understand the goals and principles behind the Restatement of the Law, Consumer Contracts, including an in-depth exploration of critical sections.

This program is ideal for consumer law attorneys, corporate counsel, and legal practitioners focusing on contracts or compliance. Whether you’re drafting, reviewing, or litigating consumer contracts, you’ll gain invaluable knowledge to navigate today’s regulatory requirements with confidence and precision.
