In his newly released book, Ballot Battles: The History of Disputed Elections in the United States, Edward B. Foley, Charles W. Ebersold and Florence Whitcomb Ebersold Chair in Law and Director of Election Law at Ohio State University, Moritz College of Law, presents a historical account of U.S. election controversies.
At the heart of Professor Foley’s book lies the premise that “because the Founding Fathers despised parties and never envisioned the emergence of a party system, they wrote a constitution that did not provide clear solutions for high-stakes and highly contested elections in which two parties could pool resources against one another.”
Professor Foley is a Reporter for the Principles of the Law, Election Administration: Non-Precinct Voting and Resolution of Ballot-Counting Disputes project, which looks to provide the clarification in this area. The next project meeting is scheduled on June 15, 2016.
