October Council Meeting Updates

At its meeting in New York City on October 18 and 19, the Council reviewed drafts for seven projects. The actions taken on the Council Drafts are listed below.

Law of American Indians
The Council approved Council Draft No. 5, subject to the discussion at the meeting and the usual editorial prerogative.

The Advisers and Members Consultative Group will meet on November 8, 2018, in New York City to discuss Preliminary Draft No. 7.

Children and the Law
The Council approved Council Draft No. 3, subject to the discussion at the meeting and the usual editorial prerogative.

The Advisers and Members Consultative Group met earlier this month to discuss Preliminary Draft No. 5, and will meet next in fall 2019 on a date to be determined.

Compliance, Enforcement, and Risk
The Council discussed Chapters 1, 2, and 3 of Council Draft No. 1 but no vote was taken. There was insufficient time to consider the remainder of the draft (Chapter 5). A revised version of Chapters 1, 2, and 3 will be included in the draft for the January 2019 Council meeting.

The Advisers and Members Consultative Group will meet on October 25, 2018, in Philadelphia to discuss Preliminary Draft No. 4.

Consumer Contracts
The Council approved Council Draft No. 5, subject to the discussion at the meeting and the usual editorial prerogative. During the discussion, the Reporters agreed to make several changes to respond to comments from project participants; these changes will be incorporated in the next draft. The Reporters will revise the draft in accordance with the discussion at the meeting and the revised material will be submitted at the 2019 Annual Meeting.

Copyright
The Council approved §§ 1.02, 1.06, 1.07, 1.08, 2.01, and 2.02 of Council Draft No. 2, subject to the discussion at the meeting and the usual editorial prerogative. During the discussion, the Reporters described their planned revisions to the material to address comments received on the draft, and agreed that § 2.01 may require updating after §§ 2.06 and 2.07 are reviewed by the Council, due to the cross-references to those Sections. The Reporters will revise the approved Sections in accordance with the discussion at the meeting and the revised material will be included in the next Council Draft for reference.

The Council also discussed § 2.07, which will be revised for consideration at a future Council meeting. In addition, the Council provided feedback on § 1.01, which was included in the draft for discussion only.

The Advisers and Members Consultative Group will meet jointly on March 7 and 8, 2019, in Philadelphia.

Intentional Torts 
The Council approved Council Draft No. 5, subject to the discussion at the meeting and the usual editorial prerogative.

The Advisers and Members Consultative Group will meet on May 3, 2019, in Philadelphia, to discuss the next Preliminary Draft.

Policing
The Council approved Chapter 1 and §§ 3.01-3.06 of Chapter 3 of Council Draft No. 2, subject to the discussion at the meeting and the usual editorial prerogative. During the discussion, the Reporters agreed to make several changes to respond to comments from project participants; these changes will be incorporated in the next draft. There was insufficient time to consider the remainder of the draft (§ 3.07, Chapter 4, and Chapter 11) at this meeting. The project will be on the agenda for the January 2019 Council meeting.

The Advisers and Members Consultative Group will meet on April 4, 2019, in Philadelphia.

J. Harvie Wilkinson III and Diane P. Wood Presented ALI’s Henry J. Friendly Medal

The American Law Institute presented J. Harvie Wilkinson III of the U.S. Court of Appeals for the Fourth Circuit and ALI Director Diane P. Wood of the U.S. Court of Appeals for the Seventh Circuit (Retired) the Henry J. Friendly Medal. Pierre N. Leval of the U.S. Court of Appeals for the Second Circuit presented the award today at the Institute’s Annual Meeting.  

Annual Meeting Daily Update - Tuesday, May 19

The second day of the Annual Meeting included the conclusion of the High Volume Civil Adjudication session, as well as sessions on the Restatements of Corporate Governance and Property. Additionally, the Institute presented its Distinguished Service award and honored its new life members.
