In the below video, Pierre N. Leval (2nd Circuit) discusses the Restatement of the Law, Copyright. Leval joined the U.S. Court of Appeals for the Second Circuit in 1993. Before that, he served on the U.S. District Court for the Southern District of New York since 1977. He serves as an Adviser for this Restatement.

Conflict of Laws

This project reexamines the increasingly important subject of conflict of laws in light of significant legal developments in the field since the influential Restatement Second was published in 1971.

Conflicts Status Chart

At the 2025 Annual Meeting, the membership voted to approve Tentative Draft No. 5, containing material from Topic 3, Substance–Procedure Distinction, of Chapter 5 on Choice of Law and Topic 1, Marriage and Other Domestic Relationships, of Chapter 9 on Families.

At the 2023 Annual Meeting, the membership voted to approve Tentative Draft No. 4, which includes material from Chapter 6, Torts; Chapter 7, Property; and Chapter 8, Contracts. A motion to amend §6.03 passed.

At the 2022 Annual Meeting, the membership voted to approve Tentative Draft No. 3, which includes §§ 5.01 to 5.06 from Chapter 5, Choice of Law, Introduction.

At the 2021 Annual Meeting, a motion to recommit § 1.03(1) and related Comments failed. The membership voted to approve Tentative Draft No. 2, which includes Chapter 1, Introduction; Chapter 2, Domicile; and Chapter 5, Choice of Law, Topic 2, Foreign Law (Introductory Comment, §§ 5.06-5.08).

All draft approvals are subject to the discussion at the meeting and usual editorial prerogative.
